2. APPLICATION OF THE TERMS AND CONDITIONS
The acceptance of the terms and conditions of sale there implies the enforcement of these conditions. They apply to all orders placed by the customer on the site MADAMECOCO.COM They involve a contract between MADAME COCO and the customer.
These general conditions of sale may be subject to amendment, the version that applies to the customer order is the version that is on the site on the date that the customer places their order. Changes to these terms of sale are binding for customers purchasing after they are posted on line and cannot be applied retrospectively to transactions previous to this date.
Madame Coco Products are exclusively intended to be sold to end consumers for their personal use with the exclusion of all resellers or intermediaries acting on behalf of resellers. Consequently, you agree and warrant that you are acting as an end consumer and that you will not, directly or indirectly, resell Madame Coco products purchased on the Websiteand/or by phone for commercial purposes.
For each purchase of Products, you will be requested to confirm your acceptance of the current Terms and Conditions of Sale applicable at the date of your order. The said terms and conditions may be viewed prior to and at the moment when you are prompted to confirm that you accept them. To indicate your acceptance, you will need to check the box “I accept the General Terms and Conditions of Sale and consent to the processing of my data, in accordance with “Madame Coco’s Privacy Policy”. 3. VALIDITY OF OUR OFFERS
Our offers are intended solely for consumers with a delivery address in Germany, Belgium, Luxemburg, Austria, Italy, Spain, Portugal, Poland, Denmark, Norway, Sweden, Hungary, Check Republic, Lithuania, Slovenia, Slovakia, Romania, Bulgaria, Greece, Estonia, Latvia, Ukraine, Switzerland, UK, Ireland, Scotland, Wales, Croatia, Serbia, Bosnia and Herzegovina.
MADAME COCO will notify the customer by email should an unavailable item be ordered. In the case of a debit or payment of an item that is not available, MADAME COCO commits to propose a credit note or refund to customers within 15 days. The order will be cancelled automatically.
4. PRICE OF PRODUCTS
Prices are presented in Euros all taxes included for Germany, Belgium, Luxemburg, Austria, Italy, Spain, Portugal, Poland, Denmark, Norway, Sweden, Hungary, Check Republic, Lithuania, Slovenia, Slovakia, Romania, Bulgaria, Greece, Estonia, Latvia, Ukraine, Switzerland, UK, Ireland, Scotland, Wales, Croatia, Serbia, Bosnia and Herzegovina, excluding any delivery charges. MADAMECOCO.COM reserves the right to modify its prices at any time but the products are invoiced at the price in force at the time of registration of the order.
The tariffs take account of possible reductions that would be granted on the MADAMECOCO.COM site. These prices are firm and not revisable during their period of validity, as indicated on the MADAMECOCO.COM site, MADAMECOCO.COM reserving the right, outside this period of validity, to modify the prices at any time. They do not include the costs of processing, shipping, transport and delivery which may be charged extra, if so specified on the sites. The payment requested from the Customer corresponds to the total amount of the purchase, including these costs.
An invoice is issued by MADAMECOCO.COM. It can be downloaded from the website where the order was placed.
VAT and Customs Duties
Any order placed on the Site and delivered may be subject to any taxes and customs duties imposed when the package reaches its destination. These customs duties and any taxes linked to the delivery of an article are at the Customer's expense and are the responsibility of the Customer.
MADAMECOCO.COM is not obliged to verify and to inform the Customer of customs duties and taxes applicable. By ordering on the Site, the Customer is considered as the official importer and obliged to respect all the laws and regulations of the country where the merchandise is received. Clients should be aware that cross-border supplies may be subject to an opening and inspection procedure by the customs authorities
5. CONCLUSION OF CONTRACT
You may at any time add Products to your selection by clicking on "Add to cart" and choose to complete your order or continue shopping.
Once you have selected the Product(s), click on "Proceed to Checkout" to begin the process of placing your order. If you already have a customer account, you will be required to log in and enter your password at this stage.
If you do not yet have an account, you will be prompted to create one by confirming your email address and subsequently creating a password.
Your login and password are strictly for personal use. Consequently, you undertake to store them safely and never disclose them to third parties. MADAME COCO B.V shall under no circumstances be held liable for any loss, theft or fraudulent use of your customer account; you undertake to inform MADAME COCO immediately in such an event. Once you have created an account you will be able to:
- monitor your deliveries and view your order history;
- return or exchange Products;
- add or edit your delivery and billing addresses for future orders;
- manage your subscription to the MADAME COCO newsletter.
After clicking on “Checkout” Madame Coco shall thereupon send the Customer an automatic order confirmation by e-mail in which the Customer's order is listed again. The automatic order confirmation merely documents that the Customer's order has been received by Madame Coco and does not constitute an acceptance of the application. The contract shall only be concluded by the delivery of the ordered goods. In this e-mail or in a separate e-mail, but at the latest upon delivery of the goods, the text of the contract (consisting of the order, the general terms and conditions and the order confirmation) shall be sent to the Customer by us on a permanent data carrier (e-mail or paper printout). The contract text will be stored in compliance with data protection. The conclusian of the Contract takes place in English language.
6. PAYMENT METHODS
Payment by Credit or Debit Card
The Customer confirms their billing address, the product, and the total price. The Customer then provides their card number, the corresponding expiry date, and the security code. The Customer finalises the payment by clicking on the button "Confirm." When clicking on "Memorise", the Customer agrees that the credit card number associated with the expiry date will be retained for future purchases.

As soon as the goods are dispatched, you will receive an automatic shipping confirmation by email. The invoice, return slip (Germany and Italy) and return label (Germany and Italy) are attached to the shipping confirmation for you to print out. Return shipping from all countries that we operate in is free of charge.

PROCESS REGARDING PARCELS NOT DELIVERED BY OUR TRANSPORT PROVIDER
These are consignments which have not been delivered to the final destination for the following reasons: Undeliverable, Not Claimed, Refused, Damaged In Transit, Opened...
8.1: Returned as "UNDELIVERABLE":
Consignments returned to MADAME COCO by the transporter with the following remark: Undeliverable. Once we have received and accepted the undelivered consignment, MADAMECOCO.COM will contact the customer to propose a new shipment if the product is still available or to offer a refund.
MADAMECOCO.COM reserves the right to reimburse an order and not to re-ship it if multiple "UNDELIVERABLE" orders have been identified.
8.2: Returned as "NOT CLAIMED":
Consignments which have not been claimed by the customer within the time limit imposed by Transport Provider.
Once we have received and accepted the undelivered consignment, MADAMECOCO.COM will contact the customer to propose a new shipment if the product is still available or offer a refund.
MADAMECOCO.COM reserves the right to reimburse an order and not re-ship it if multiple " NOT CLAIMED" orders have been identified.
8.3: Returned as "REFUSED":
The consignment has been refused during delivery attempt. Once we have received and accepted the undelivered consignment, a credit note will put in the customer account within 72 hours following receipt of the undelivered consignment. The Customer may request a refund and thus cancellation of the credit note directly on their customer account.
LIABILITY
The customer's claims for damages are excluded. Excluded from this are claims for damages by the customer resulting from injury to life, body or health or from the violation of essential contractual obligations (cardinal obligations) as well as liability for other damages that are based on an intentional or grossly negligent breach of duty by MADAME COCO, its legal representatives or vicarious agents. Essential contractual obligations are those whose fulfillment is necessary to achieve the purpose of the contract. In the event of a breach of essential contractual obligations, MADAME COCO shall only be liable for the damage that is typical for the contract and foreseeable if this was caused by simple negligence, unless the customer has claims for damages arising from injury to life, body or health. The restrictions in paragraphs 1 and 2 also apply to the benefit of MADAME COCO’s legal representatives and vicarious agents if claims are asserted directly against them. The provisions of the Product Liability Act remain unaffected.
PROCEDURE FOR RETURNS, EXCHANGES AND REFUNDSThe Products must be returned from any country within the Delivery Area and in the manner set out below.
If you wish to return the product from a country outside the Delivery Area, you will be solely responsible for the cost of returning the product, including any additional costs (taxes and/or customs duties) and/or any formalities for clearing customs. MADAME COCO shall in no way be liable for any loss, damage and/or delays related to returns made from a country outside the Delivery Area. Any return of a Product by MADAME COCO after the legal guarantee of conformity has been implemented may only be made within the Delivery Area.
Products bought in Madame Coco stores cannot be exchanged nor returned via the Website.
In the context of the right of withdrawal, you must ensure that the Products are returned in their original condition and packaging (the orange box and the shipping carton), and accompanied by their invoice or a copy of the invoice in the case of a partial return.
Returning a product as part of an exchange is free of charge. For this to be possible, you have to return the Products to us using one of our selected carrying firms within thirty (30) days of your withdrawal notification, and by using our prepaid return label service.
